1. Scope and data roles

This policy explains how we collect, use, disclose, store, and protect information when you visit the Foundax official website, contact us, request a demo, create an account, use platform features, or otherwise engage with us.

For information relating to you, your employees, your business contacts, and account administration, NovaRise International Limited will generally act as the controller or business operator deciding how and why that information is processed.

If you use Foundax to create websites, landing pages, forms, checkout pages, or other visitor-facing experiences and process personal information belonging to your end users, customers, employees, or other third parties, you will generally be the controller or business operator for that data and we will generally act only as your service provider or processor under your instructions.

If we enter into an order form, master services agreement, data processing agreement, or another written contract with you, that document will control to the extent it specifically covers the subject matter.

2. Information we collect

  • Information you provide directly, such as name, email address, phone number, company name, job title, billing information, support requests, contract details, and demo request information.
  • Account and workspace information, such as login credentials, team member information, roles and permissions, site configuration, page content, publishing settings, domain settings, transaction-related configuration, and marketing or integration settings.
  • Device and usage information, such as IP address, browser type, device identifiers, access times, clickstream data, audit logs, performance logs, and security event records.
  • Information from third parties, such as payment, identity, advertising, analytics, email, customer support, or other integration providers connected to your account or workflows.
  • Customer data or end-user data you process through Foundax, such as form submissions, order-related information, shipping or contact information, page activity data, and other business data you upload or process through the service.

3. Purposes of processing and legal bases

  • To provide the service, create and manage accounts, fulfill orders, process payments, and deliver customer support and maintenance.
  • To authenticate users, administer permissions, manage risk, detect abuse, investigate incidents, prevent fraud, and maintain the security and integrity of the service.
  • To support billing, reconciliation, tax administration, audit, internal administration, product improvement, performance analysis, and operational optimization.
  • To send service-related notifications, billing notices, important updates, security alerts, and, where permitted by law, marketing communications.
  • Where required by applicable law, we may rely on contractual necessity, legitimate interests, compliance with legal obligations, protection of vital interests, or your consent as our legal basis for processing.

4. Cookies, analytics, and marketing technologies

We may use cookies, pixels, SDKs, local storage, and similar technologies to maintain sessions, support security, remember preferences, analyze traffic, measure campaign performance, and improve the service.

You may control some of these technologies through your browser settings, device permissions, or the settings tools we make available, but disabling them may affect functionality.

  • If you enable advertising, analytics, attribution, or other third-party marketing tools, those technologies may collect or receive information in accordance with their own rules and settings.
  • Third-party cookies and marketing technologies are governed by the applicable third-party privacy policies, and we do not control how those providers use information after receipt.

5. Sharing, disclosure, and international transfers

Except as described in this policy, with your authorization, or as required by law, we do not sell your personal information to unrelated third parties.

  • We may share information with infrastructure, payment, authentication, analytics, monitoring, email, customer support, anti-fraud, storage, and other service providers that help us operate the service.
  • We may share information within our corporate group, with affiliates, professional advisers, auditors, and in connection with financing, merger, acquisition, restructuring, or similar corporate transactions, subject to appropriate safeguards.
  • We may disclose information where necessary to comply with law, regulation, legal process, governmental request, or to establish, exercise, or defend legal rights.
  • Because our infrastructure and teams may operate across multiple jurisdictions, information may be transferred to countries or regions outside your own. Where required by law, we will implement reasonable safeguards for cross-border transfers.

6. Retention and security

We retain information for the shortest reasonable period necessary to fulfill the purposes described in this policy, taking into account contractual performance, tax, audit, dispute resolution, backup and recovery, security investigation, and applicable legal requirements.

We use reasonable technical, administrative, and organizational safeguards designed to protect information, including access controls, role-based restrictions, logging, backups, encryption in transit, and security monitoring. However, no transmission or storage system can be guaranteed to be completely secure, and we cannot guarantee that information will never be accessed, disclosed, altered, or destroyed.

7. Your responsibilities for end-user data

If you use Foundax to collect, display, or otherwise process personal information relating to end users, customers, employees, or other third parties, you are responsible for ensuring you have a lawful basis to do so and for complying with applicable data protection, consumer protection, advertising, communications, and e-commerce laws.

  • You are responsible for preparing and presenting your own privacy notices, cookie disclosures, terms of service, refund or after-sales policies, and any other legally required disclosures to your end users.
  • You are responsible for obtaining necessary consents, managing marketing subscriptions, responding to rights requests, and ensuring the accuracy, legality, and completeness of the data you upload or process.
  • If you connect third-party payment, advertising, analytics, customer support, or other services, you are responsible for evaluating and complying with the applicable terms, policies, and legal requirements for those services.

8. Your rights and choices

Subject to applicable law, you may have the right to request access to, correction of, deletion of, restriction of processing of, objection to processing of, or export of your personal information, and to withdraw previously given consent. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

If you opt out of marketing communications, we may still send you non-marketing messages relating to your account, security, billing, service changes, or other necessary operational matters.

9. Children

Foundax is intended for business, organizational, and commercial use and is not directed to children. If you believe that a child has provided personal information without appropriate authorization, contact us and we will take reasonable steps to address the issue.

10. Policy changes and contact

We may update this policy from time to time for product, legal, regulatory, security, or operational reasons. Updated versions will become effective on the stated effective date, and where required by law we will provide notice of material changes through the website, in-product notices, email, or another reasonable method.
